Honda and its Guangzhou joint venture (JV) filed a patent infringement case against motorbike makers Chongqing Lifan and Shanghai Wen'an at the Shanghai No.2 Intermediate People's Court. The court recently awarded Honda an injunction and 600,000 yuan in damages. Honda owns invention patent titled support structure of the retrieval box under the seat of smallvehicle and licensed it to its Guangzhou JV, Wuyang Honda. As a licensee in China, the Wuyang Honda was permitted to file patent litigation as a co-plaintiff. In April 2004, Honda and Wuyang Honda alleged the support structure of the trunk on Lifan's motorbike LF125T-2D infringed its patent. Wen'an was the distributor of the alleged product. The court found infringement established on LF125T-2D, ordered Lifan, Wen'an to cease infringement and indemnify 612,600 yuan in damages. |
